Town withdraws lawsuit against Caponera LLC

The town is withdrawing its lawsuit against the business looking to open a beer and wine garden restaurant on lower Main Street, according to a letter sent by the town manager to the proprietors.

In a June 22 letter to Roxanne Poulin and Sam Flinkstrom, Town Manager Tim Pellerin said the town was filing a notice of dismissal in the pending land use enforcement case related work at 406 Main St., where Poulin and Flinkstrom hope to open the Happy Valley Beer and Wine Garden.

The town in May filed a lawsuit against Caponera, the couple’s business entity, alleging it had violated a stop work order issued by the town.
